1. Our services

FaunaMap provides a digital platform that helps people discover, record, identify, organize, and share wildlife observations, including observations of birds and other species.

Depending on your location, device, account settings, the currently available functionality, and your subscription, our services may include:

• Recording observations of birds, mammals, and other wildlife.
• Adding dates, times, locations, notes, photographs, and audio recordings to observations.
• Viewing observations, maps, wildlife hotspots, and biodiversity information.
• Maintaining personal species lists and observation histories.
• Publishing photographs, observations, and comments and interacting with other users.
• Participating in community discussions, identification assistance, rankings, quizzes, groups, or other social features where available.
• Using automated or artificial intelligence-assisted species identification.
• Sharing observations with other users or contributing biodiversity data to disclosed research and conservation initiatives.
• Accessing optional premium features through paid subscriptions.

Some features may differ between our website, iOS application, and Android application. A feature mentioned as optional, conditional, or available in certain versions is not necessarily available to every user.

We may update, improve, modify, or discontinue individual features from time to time. If a material change affects a paid subscription, we will respect your applicable contractual and statutory rights.

Feeds, search results, rankings, and recommendations

Where FaunaMap provides a feed, search result, wildlife hotspot, suggested observation, species recommendation, user ranking, or similar ordering feature, the main factors used to determine its presentation may include relevance to the selected species or location, distance, observation date and time, season, record completeness, image or recording quality, community activity, user preferences, prior interactions, data reliability, moderation status, and wildlife-protection requirements.

The importance of these factors may differ by feature and may change to improve usefulness, safety, reliability, or conservation outcomes. Where available, you may adjust search filters, sorting, location settings, or personalization controls. If a paid placement, commercial relationship, or subscription benefit materially affects ranking or visibility, we will identify that influence where required by law.

2. Accounts, eligibility, and children

You may need an account to access certain features. When creating or using an account, you agree to provide accurate information and keep your account details reasonably up to date.

You are responsible for maintaining the security of your account and for activities carried out through it, unless those activities result from circumstances for which you are not legally responsible. Notify us promptly if you believe your account has been accessed without authorization.

Unless a higher minimum age applies in your country, you must be at least 16 years old to create and manage a FaunaMap account independently. If you are younger than 16, you may use FaunaMap only where we make that use available and only with the valid permission and appropriate involvement of a parent or legal guardian. We may request reasonable age or parental-consent verification where necessary and permitted by law.

We may restrict public profiles, direct messages, public posting, exact-location sharing, or other social features for users whom we know or reasonably believe to be minors. Parents and guardians are responsible for supervising permitted use by their children.

Paid subscriptions may only be purchased by a person authorized to use the relevant Apple App Store, Google Play, or other approved payment account. You may not create an account or publish content on behalf of another person without authority.

Unless we expressly permit organizational or shared access, an account is personal to its authorized user. You must not sell, rent, lend, transfer, or share account credentials; access another person's account without authorization; create misleading duplicate accounts; use multiple accounts to manipulate observations, rankings, subscriptions, or reports; or create a replacement account to evade a suspension, termination, or other enforcement action.

We may suspend or restrict an account when reasonably necessary to protect users, children, wildlife, the integrity of the platform, or our legal obligations. Section 19 describes moderation safeguards and available review options.

3. Free and paid features

FaunaMap may offer both free features and paid premium features. The availability and scope of each plan will be explained in the app, on our website, or during the subscription process before you purchase.

Downloading the app or creating an account does not, by itself, require you to purchase a subscription unless this is clearly stated before you proceed. Paid features may include additional tools, functionality, limits, content, or benefits described at the time of purchase.

Subscriptions provide ongoing access to the features and recurring value described for the applicable plan during the relevant subscription period. We may change features available under a free plan. Changes to paid features will be handled in accordance with applicable law and the terms presented when you subscribed.

4. Subscription offers and pricing

Subscription options, prices, billing periods, automatic-renewal terms, relevant trial conditions, and included features are displayed before you complete a purchase.

Prices may vary by country, region, currency, platform, promotional offer, or applicable taxes. The price and billing period shown by the Apple App Store, Google Play, or another authorized payment provider at the time of purchase determine the amount payable for that subscription period.

Where required by applicable law, displayed consumer prices include applicable taxes or clearly indicate whether taxes will be added. We may offer different subscription periods, including monthly and annual subscriptions.

An annual subscription is charged for the full annual amount unless the purchase screen explicitly states a different payment arrangement. Any monthly equivalent displayed for an annual subscription is for comparison only and does not change the total amount charged for the annual billing period.

The contract is formed through the purchase and confirmation flow of the applicable app store or other authorized sales channel. Any additional mandatory pre-contractual information is provided in that flow or through clearly accessible links.

5. Apple In-App Purchase and Google Play Billing

Subscriptions purchased inside our iOS app are processed through Apple In-App Purchase where required. Subscriptions purchased inside our Android app distributed through Google Play are processed through Google Play Billing where required. These purchase mechanisms are distinct from standalone Apple Pay or Google Pay payment experiences.

FaunaMap supplies the app and the FaunaMap service. The app store, its designated entity, or its authorized payment partner processes billing and may act as the merchant, reseller, commercial agent, or other contracting party for the payment transaction, depending on your location and the applicable app store arrangement. The identity shown in your purchase confirmation, invoice, and app store terms governs the payment transaction.

Your purchase may also be subject to the applicable terms and policies of Apple or Google. The relevant app store generally handles payment authorization, receipts, subscription management, renewal billing, and refund requests submitted through its systems. FaunaMap handles questions about the operation of the FaunaMap service and will assist with purchase-related issues to the extent within its control.

FaunaMap does not receive your complete payment card details when payment is processed by Apple or Google. You are responsible for ensuring that your app store account and payment method remain valid.

If payment cannot be collected, the app store may apply a grace period, billing-retry period, account hold, suspension, or cancellation under its own rules. Access to paid features may be suspended or discontinued in accordance with those rules, your plan, and your legal rights.

Purchases may be associated with the app store account used to complete the transaction and, where supported, with your FaunaMap account. Access across different devices or platforms depends on the functionality expressly described for your plan and the rules of the relevant app store. Unless clearly stated otherwise, an Apple purchase does not automatically create a separate Google Play subscription, and a Google Play purchase does not automatically create a separate Apple subscription.

6. Automatic renewal

Unless otherwise stated during purchase, subscriptions renew automatically at the end of each billing period until cancelled. The renewal period will be the same as the preceding subscription period unless you are clearly informed otherwise before renewal.

Your Apple App Store or Google Play account will be charged the applicable renewal price according to the billing arrangements and timing used by the relevant app store. By purchasing an automatically renewing subscription, you authorize recurring charges until your subscription is cancelled, expires, or is otherwise terminated in accordance with these Terms and applicable law.

We or the relevant app store will provide renewal notices or reminders where required by applicable law. If local law gives you additional rights after an initial subscription period, including the right to cancel with a shorter notice period or obtain a partial refund, those rights take precedence over these Terms.

7. Free trials and introductory offers

We may offer free trials, introductory prices, discounts, or other promotional subscription offers. If an offer is available, its duration, applicable conditions, the price after the offer ends, and the subsequent billing period will be disclosed before you subscribe.

Unless the offer states otherwise, a free trial or introductory subscription automatically converts into a paid, automatically renewing subscription at the end of the promotional period. You must cancel through the applicable app store before the deadline shown in the purchase flow if you do not wish to be charged for the next period.

Eligibility may be determined by Apple, Google, FaunaMap, or the applicable offer conditions. We may restrict promotional offers to new subscribers or users who satisfy clearly communicated eligibility requirements. Any unused portion of a free trial may be affected by a purchase, plan change, cancellation, or app store rule where disclosed during the transaction.

8. Managing, restoring, and cancelling subscriptions

You can manage or cancel your subscription through the platform used to purchase it. For Apple subscriptions, use your Apple account subscription settings or Apple subscription management. For Google Play subscriptions, use Google Play subscription management or any applicable subscription-management option made available within FaunaMap.

Where supported, eligible prior purchases can be restored through the app's restore-purchases function, the relevant app store account, or account synchronization. Restoration does not create a new subscription and does not extend the original billing period.

Deleting the FaunaMap app, deleting your FaunaMap account, signing out, or stopping use of the service does not automatically cancel an Apple or Google subscription. Cancel that subscription separately through the platform used to purchase it.

Unless applicable law provides otherwise, cancellation stops future automatic renewal and you will generally retain access to paid features until the end of the current paid billing period. Applicable law may provide additional cancellation rights, including immediate cancellation, cancellation after an initial fixed period, a shorter notice period, or a full or partial refund.

We will not limit or exclude any cancellation right to which you are entitled under mandatory consumer protection law. If you experience difficulties cancelling, contact .

9. Refunds and statutory withdrawal rights

Refund eligibility depends on the applicable app store rules, the identity of the party responsible for the payment transaction, the circumstances of the purchase, and mandatory consumer protection laws in your country.

For purchases processed by Apple, a refund request may need to be submitted through Apple's refund-request service. For purchases processed by Google Play, a refund request may need to be submitted through Google Play's refund process. Contact us if you need assistance identifying the responsible party.

Nothing in these Terms limits your right to request a refund where required by law. If you are a consumer located in the European Economic Area, the United Kingdom, or another jurisdiction that provides a statutory cooling-off or withdrawal period, you may have the right to withdraw from a qualifying distance contract within the applicable legal period.

For consumers in the European Economic Area, this period will generally be 14 days from the conclusion of a qualifying service subscription agreement, unless a valid legal exception applies.

If you expressly request that the digital service begin during the withdrawal period and you are properly informed of the consequences, you may be required to pay a proportionate amount for the service provided before withdrawal, where permitted by law. An exception applicable to digital content, or a loss of a withdrawal right for a fully performed service, applies only where all legally required information, express consent, acknowledgment, confirmation, and other conditions have been satisfied.

To exercise a statutory withdrawal right, use the refund or withdrawal process of the party identified in your order confirmation. Where FaunaMap is the relevant contracting party or responsible for receiving the request, you may contact or use the applicable withdrawal function in our online interface. We will promptly direct a request sent to the wrong channel where reasonably possible.

Where FaunaMap is legally required to provide an online withdrawal function for a qualifying online contract, we will make that function clearly accessible, permit submission through an appropriate confirmation step, and provide confirmation as required by law. You may use the model withdrawal notice at the end of these Terms, but you are not required to do so.

10. Subscription price changes

We may change subscription prices for future subscription periods. Any price change will be communicated in accordance with applicable law and the rules of the relevant app store.

Where required, you will receive advance notice and an opportunity to cancel before the new price takes effect. If applicable law or the app store requires your express consent to a price increase, the new price will not apply without that consent. A price change will not retroactively alter an amount already paid for an existing billing period.

11. Wildlife observations and location information

FaunaMap allows users to record observations containing information such as species, date, time, exact or approximate location, descriptions, photographs, and audio recordings. You are responsible for ensuring that the information you submit is accurate to the best of your knowledge and that you are entitled to submit it.

An observation and its associated coordinates may reveal information about the observer, another person, private property, a protected habitat, or the presence of vulnerable wildlife. A timestamp, repeated observations, profile details, or image metadata may make an otherwise ordinary location personally sensitive.

Before sharing an observation, review its selected audience, location precision, attached photographs, recording details, and any available metadata. Do not disclose another person's private location, home address, movements, private property, or other personal information without an appropriate legal basis and, where required, their permission.

Location information and maps may be incomplete, delayed, imprecise, or inaccurate. You must not rely on FaunaMap as your sole source of information for navigation, emergencies, property boundaries, wildlife safety, protected-area restrictions, or legal access to land.

12. Location visibility and sharing

The audience and precision of an observation are determined by the sharing controls and explanations presented when the observation is created, edited, or published. Depending on the available functionality, an observation may be:

• Private: visible only to you and to authorized service personnel or processors where necessary to operate the service.
• Shared with selected users: visible to the recipients, group, or community specifically identified in the sharing interface.
• Public with an approximate location: visible to other users or the public with coordinates rounded, generalized, obscured, or delayed.
• Public with an exact location: visible to the audience identified in the sharing interface with the exact or near-exact coordinates you choose to disclose.

We will make the intended audience and location precision reasonably clear before publication. Exact location data will not be intentionally displayed publicly without a deliberate sharing choice, except where you have explicitly configured a setting that clearly provides for that publication. More protective settings may apply to sensitive species, minors, safety concerns, or legal requirements.

Public observations may be viewed, searched, linked to, captured, or shared by other users and may become discoverable outside FaunaMap where public access or indexing is enabled. Recipients of a shared observation may retain information they have already viewed or lawfully copied.

Changing visibility, editing coordinates, or deleting an observation affects future display within FaunaMap as soon as reasonably practicable, but may not automatically remove previously downloaded copies, screenshots, search-engine caches, or data already lawfully published by an independent third party. We will honor applicable data-protection rights and take appropriate action where continued processing is within our control.

We may remove, suppress, generalize, delay, or otherwise limit location information where reasonably necessary to protect users, other individuals, private property, wildlife, protected habitats, or legal compliance.

13. Protection of wildlife and sensitive species

You agree to use FaunaMap in a manner that respects wildlife, habitats, landowners, other users, and applicable laws. You must not use FaunaMap to:

• Disturb wildlife, breeding sites, nests, roosting sites, or protected habitats.
• Encourage others to approach animals, nest sites, or habitats in a harmful or unsafe manner.
• Enter restricted areas or private property without authorization.
• Facilitate poaching, illegal collection, trafficking, persecution, harassment, or disturbance of wildlife.
• Publish sensitive locations where doing so creates a foreseeable risk to wildlife, landowners, or people.
• Publish information intended to circumvent conservation restrictions or protective location controls.
• Misrepresent wildlife observations or deliberately manipulate biodiversity records.

We may identify species, locations, seasons, or habitat types as sensitive. For those observations, we may automatically obscure coordinates, expand the visible area, delay publication, limit access to approved conservation partners, require additional review, or prevent public posting. Protective measures may apply even when you request broader visibility.

FaunaMap cannot guarantee that all sensitive records will be detected or that publicly shared information will never be misused. You remain responsible for following local access rules, nature-protection laws, safety instructions, and guidance issued by relevant authorities.

Our published nature guidelines supplement these Terms.

14. User content and platform license

“User Content” means material you submit, upload, publish, or otherwise make available through FaunaMap, including observations, photographs, audio recordings, comments, profile information, and messages.

You retain ownership of the intellectual property rights that you hold in your User Content. By submitting, uploading, or sharing User Content, you grant FaunaMap a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, technically adapt, format, annotate, analyze, display, communicate, and distribute that content to the extent reasonably necessary to:

• Operate, secure, maintain, and provide FaunaMap.
• Display or share your content in accordance with the audience, visibility, and functionality you select.
• Provide mapping, observation, identification, community, accessibility, and support features.
• Create technical copies, thumbnails, backups, previews, resized images, and other formats needed to operate the service.
• Use hosting, infrastructure, moderation, mapping, identification, or other service providers acting on our behalf under appropriate contractual safeguards.
• Develop, train, test, evaluate, validate, maintain, and improve FaunaMap-related identification tools, machine-learning models, artificial intelligence systems, biodiversity analysis, species-recognition features, audio-recognition features, quality controls, and other functions related to wildlife observation and conservation, including by processing submitted photographs, audio recordings, species labels, annotations, and relevant observation information.
• Facilitate biodiversity research or conservation sharing only where separately disclosed and permitted under Section 16.

We may grant our contracted service providers, infrastructure providers, and technical development partners a limited right to process User Content on our behalf solely for the purposes described above and under appropriate contractual safeguards. This platform license does not transfer ownership of your photographs, recordings, or other protected content and does not authorize an independent third party to use your content for its own unrelated model, product, or commercial purpose.

Where User Content contains personal data, model development or training will be subject to our Privacy Policy, an applicable legal basis, data-minimization requirements, relevant user choices, and any additional notice, consent, objection, deletion, or other rights required by law. We may remove or reduce direct identifiers, sensitive location details, unnecessary metadata, or other information before processing where appropriate. Additional safeguards may apply to content associated with known minors or vulnerable species.

The license lasts while your content remains on FaunaMap and ends within a reasonable time after you delete the content or your account, except to the extent necessary for temporary backups, legal retention, fraud prevention, dispute resolution, previously authorized third-party publication, content lawfully incorporated into an independent scientific dataset, or lawfully created aggregated statistics, annotations, technical improvements, and model parameters that do not reasonably identify you or reproduce your protected content. Separate permissions or open-data licenses that you expressly approve may continue according to their own terms. This provision does not limit applicable data-protection rights or require retention of identifiable source content after deletion.

We will not use a user photograph, recording, or other protected User Content in independent advertising, external promotional campaigns, or an unrelated third-party general-purpose artificial intelligence model without a separate permission or another valid legal basis clearly disclosed to you. Displaying a public post within FaunaMap or in a technically generated preview requested through ordinary sharing is not, by itself, independent advertising.

You represent that you have the rights necessary to submit your User Content and that doing so does not violate another person's rights, applicable law, or these Terms.

Feedback and suggestions

If you voluntarily provide ideas, feature requests, bug reports, or other feedback about FaunaMap, we may use, adapt, develop, and implement that feedback to operate or improve our services without owing compensation. This permission applies to the suggestion itself and does not transfer ownership of your photographs, recordings, observations, or other protected User Content.

15. Photographs, recordings, and third-party privacy

Photographs, videos where supported, and audio recordings may contain faces, voices, vehicle registration numbers, addresses, homes, private land, children, or embedded metadata that reveals where and when the material was created.

Before posting, you must ensure that publication respects applicable privacy, portrait, copyright, recording, and child-protection laws. Do not upload intimate imagery, exploitative material, unlawfully recorded conversations, identifiable photographs of children without necessary authorization, or content that reveals another person's precise location or private information without a valid basis.

Where technically appropriate, FaunaMap may strip, suppress, or restrict access to embedded EXIF, GPS, device, or similar metadata in publicly served media. This does not guarantee that visible landmarks, descriptions, filenames, associated observation data, or other information cannot identify a location or individual.

If you believe content violates your privacy, portrait rights, intellectual property, or another legal right, report it using the applicable in-app reporting option or contact .

16. Biodiversity data, research, and GBIF

FaunaMap may support biodiversity research, conservation, and scientific collaboration by sharing selected wildlife observation data with disclosed biodiversity initiatives, research institutions, conservation organizations, or the Global Biodiversity Information Facility (GBIF).

Where such sharing is offered, we will explain the recipient or recipient category, the type of information to be shared, the relevant visibility choice, and any applicable open-data license before publication or sharing where required. Depending on the selected arrangement, information may include species identification, observation date, approximate location, precise location, observer attribution, images, recordings, or other observation-related information.

Personal information, observer names, photographs, audio recordings, and precise coordinates will be shared only where consistent with our Privacy Policy, the applicable legal basis, your settings and choices, protective location restrictions, and any permissions required by law. A platform-sharing setting does not automatically authorize use of protected photographs for an unrelated research or marketing purpose.

Where an observation or dataset is published under an open-data license, the applicable license and its practical consequences will be identified before publication where required. An open license may allow independent third parties to access, copy, reuse, redistribute, adapt, analyze, or retain the published data under that license.

If information has already been lawfully published under an open license or shared with an independent third party, deleting your FaunaMap account or withdrawing a future-sharing choice may not automatically remove copies that were already downloaded, republished, anonymized, or incorporated into scientific datasets. This does not limit any right under applicable data protection law to request access, correction, restriction, objection, or deletion of personal data.

We may withhold, delay, restrict, or generalize sensitive species locations to protect wildlife or comply with legal requirements, including when research sharing is otherwise enabled.

17. Artificial intelligence and automated identification

FaunaMap may provide tools that suggest species identifications based on photographs, audio recordings, location, season, date, or other information. These tools are intended to assist users and their results are not guaranteed to be accurate, complete, or suitable for every situation.

Identification may be affected by image quality, background noise, environmental conditions, location accuracy, available reference data, or limitations of the underlying technology. You remain responsible for reviewing and confirming observations before relying on them or publishing them.

AI-generated suggestions do not constitute scientific certification, professional ecological advice, legal advice, safety advice, or confirmation that a species is present at a particular location. Do not use identification results as the sole basis for decisions involving public safety, protected species, access restrictions, regulatory compliance, or environmental risk.

Photographs, audio recordings, species labels, annotations, and relevant observation information may be processed to provide requested identification features and to develop, train, test, evaluate, validate, and improve FaunaMap-related species-recognition, audio-recognition, biodiversity, conservation, or quality-control systems, as permitted by the platform license in Section 14 and described in our Privacy Policy.

Where this processing involves personal data, FaunaMap will identify an applicable legal basis, provide the information required by law, apply appropriate safeguards and data minimization, and honor applicable rights, including objection, withdrawal of consent where consent is used, access, correction, and deletion. This does not authorize independent third parties to train unrelated general-purpose models on User Content.

18. Community rules

FaunaMap may offer comments, messaging, identification assistance, shared observations, rankings, groups, or other community features. Before users are permitted to upload or publish User Content, we require acceptance of applicable content and community rules.

You agree to interact respectfully. You must not:

• Harass, threaten, stalk, discriminate against, intimidate, or abuse another user.
• Publish hate speech, unlawful discrimination, threats of violence, or material exploiting or endangering a child.
• Share another person's personal information, private messages, home address, precise location, or other confidential information without authorization.
• Upload unlawful, sexually exploitative, defamatory, deceptive, abusive, or otherwise harmful material.
• Publish spam, scams, malware, phishing links, undisclosed advertising, or misleading commercial messages.
• Infringe intellectual property, portrait, privacy, or other rights.
• Impersonate another person or misrepresent your identity or an affiliation.
• Manipulate rankings, observations, comments, or community activity through bots, automation, fake accounts, or fraudulent conduct.
• Sell or exchange account access, evade an account suspension, coordinate fraudulent reports, or use another account to continue conduct that has been restricted.
• Encourage illegal access, harassment of wildlife, exposure of protected nesting sites, or other violations of Section 13.
• Use blocking, reporting, complaint, or appeal tools in a deliberately abusive or fraudulent manner.

Additional context-specific rules, safety notices, and nature guidelines may apply when clearly presented. Enforcement will take account of context, severity, recurrence, safety, the interests of affected users, and applicable law.

We may also take proportionate action regarding conduct outside FaunaMap where that conduct has a direct and substantial connection to FaunaMap, its users, shared observation information, sensitive wildlife locations, or a credible threat to a person's or animal's safety. Examples include stalking a user through shared observations, selling protected nest coordinates obtained through FaunaMap, threatening a community member, or deliberately disturbing wildlife using information taken from the service.

19. Reporting, moderation, and appeals

Reporting and blocking

FaunaMap provides accessible means to report objectionable content and users and to block abusive users where user-to-user interaction is available. Reporting options should be available in or near relevant content, profiles, comments, messages, or observation details. Reports may also be submitted to .

When reporting illegal content, provide enough information for us to identify and assess the content, including its location or URL, an explanation of why you believe it is unlawful, and your contact information where required. We may request additional information where reasonably necessary. Contact details are not required when applicable law permits an anonymous or protected report.

Copyright and intellectual-property reports

For an intellectual-property complaint, identify the protected work or legal right, explain your relationship to the right holder, identify the allegedly infringing material and its location within FaunaMap, provide an appropriate means of contacting you, and explain why you believe in good faith that the reported use is unauthorized or otherwise unlawful. Do not include information that is unnecessary or unsafe to share.

Where appropriate and lawful, we may ask the reporting person or uploader for additional information, temporarily limit access while assessing the report, notify the uploader of the allegation, and offer an opportunity to respond or challenge the decision. We may restrict or terminate accounts responsible for repeated substantiated infringements. Knowingly false, abusive, or misleading intellectual-property reports may themselves lead to enforcement action.

Review and enforcement

We review notices in a timely, diligent, objective, and non-discriminatory manner. We may use technical detection tools, user reports, trained reviewers, and contextual assessment to identify spam, unlawful material, harmful imagery, sensitive wildlife locations, or other violations. Automated tools may assist moderation but are not a substitute for appropriate human review where required.

Depending on the circumstances, we may remove content, restrict its visibility, obscure coordinates, disable comments, issue a warning, suspend a feature, temporarily restrict an account, permanently terminate an account, preserve relevant information where legally required, or report a serious matter to a competent authority.

We assess proportionality by considering the nature and seriousness of the material, possible harm to wildlife or people, the rights and interests involved, the user's history, urgency, and any legal obligations. Immediate action may be taken where necessary to protect children, prevent imminent harm, preserve security, or comply with law.

Notice, reasons, and review

Where required by applicable law, we will acknowledge legally sufficient notices, inform the reporting person of the outcome where permitted, and provide an affected user with a clear statement of reasons for a significant content or account restriction. Users may challenge a moderation decision through an available in-app appeal mechanism or by emailing . Identify the decision, the affected content or account, and the reason you believe the decision should be reconsidered.

We will review a properly submitted appeal in a timely and fair manner. Where applicable law provides access to an internal complaint system, an out-of-court dispute-settlement body, a Digital Services Coordinator, a competent authority, or a court, those rights remain available. The precise obligations applicable to FaunaMap depend on the nature and size of the service and any lawful exemption.

20. Intellectual property and permitted use

FaunaMap, including its software, design, branding, logos, databases, maps, text, and original content, is owned by or licensed to Falco Solutions or its licensors. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use FaunaMap for its intended purposes.

You must not, except where applicable law expressly permits:

• Copy, resell, sublicense, or commercially exploit FaunaMap without authorization.
• Reverse engineer or interfere with the service.
• Scrape, systematically extract, harvest, or commercially reuse platform data without permission.
• Circumvent security measures, location protections, usage limits, access controls, or subscription restrictions.
• Use automated tools that unreasonably burden or disrupt our systems.
• Use another user's photograph, recording, comments, or other protected content beyond the permission they have granted.
• Use photographs, audio recordings, observations, coordinates, comments, or other FaunaMap content to train, test, evaluate, operate, or improve an external artificial intelligence or machine-learning system without our prior written authorization and any necessary authorization from the relevant rights holders.
• Probe, scan, test, exploit, or attempt to compromise the security or vulnerability of the service, its infrastructure, or another user's account without our prior authorization.
• Upload malicious code, falsify request headers or technical identifiers, build an unauthorized client, publish or misuse a private application programming interface, or evade access, rate, or account restrictions.
• Reverse-calculate, infer, reconstruct, correlate, or otherwise attempt to reveal coordinates, nest sites, routes, or sensitive habitat information that FaunaMap has obscured, generalized, delayed, or restricted.
• Use our trademarks or branding in a way that creates confusion about endorsement or affiliation.

Third-party maps, taxonomy data, scientific datasets, open-data records, and other external content may be subject to additional licenses or terms. Nothing in this section limits uses that cannot lawfully be prohibited.

21. Third-party services

FaunaMap may use or connect with services operated by third parties, including Apple, Google, mapping providers, hosting providers, AI-service providers, biodiversity databases, authentication services, and payment providers.

Third-party services may have their own terms, privacy policies, technical limitations, and availability. We are not responsible for services operated independently by third parties except where applicable law provides otherwise.

If a third-party service changes, becomes unavailable, or discontinues an integration, certain FaunaMap features may also change or become unavailable. Any sharing of personal data with third parties will be governed by our Privacy Policy, the roles of the relevant parties, appropriate contractual safeguards, and applicable data protection law.

22. Availability, updates, and service changes

We aim to keep FaunaMap available, secure, and reasonably reliable. Uninterrupted access cannot be guaranteed. The service may occasionally be affected by maintenance, software updates, network disruptions, third-party outages, security incidents, or circumstances beyond our reasonable control.

Offline functionality depends on your device, previously stored information, available storage, and the specific features involved. We may release updates to improve security, performance, compatibility, or functionality. You may need to install updates or maintain a compatible operating system to continue using certain features.

Nothing in these Terms limits rights that consumers may have concerning the conformity, security, maintenance, required updates, or continued supply of digital services. If we permanently discontinue a paid service or materially reduce its contracted functionality, we will provide any notice, cancellation rights, refund, or other remedy required by applicable law.

23. Privacy and data protection

Our collection and use of personal data are described in our Privacy Policy. These Terms do not replace that policy and acceptance of these Terms does not, by itself, constitute consent to an optional processing activity that legally requires separate consent.

Depending on your use of FaunaMap, personal data may include account information, age or parental-consent information, exact or approximate location, observation details, photographs, audio recordings, communications, device information, moderation records, and subscription-related information.

Our Privacy Policy explains, among other things:

• What personal information we collect and the relevant sources.
• The purposes, legal bases, and retention periods for processing.
• Whether information is private, shared with selected users, public, or shared with independent third parties.
• How exact and approximate locations, observation data, photographs, recordings, and image metadata are processed.
• How biodiversity research sharing, GBIF publication, identification tools, FaunaMap-related machine-learning development or training, and external processors or technical development partners are handled.
• How children and known minors are protected.
• How users can manage account, visibility, sharing, and privacy settings.
• How users can exercise rights of access, correction, deletion, restriction, objection, and portability where applicable.
• How to contact us or a competent supervisory authority about privacy matters.

Your use of FaunaMap is subject to the privacy choices and settings made available to you. You should review the selected audience and location precision before making an observation or profile public.

24. Account deletion and termination

You may stop using FaunaMap at any time. If FaunaMap permits account creation within an app, an accessible in-app account-deletion process will be made available as required by the applicable app store rules. You may also contact for assistance.

Before account deletion, you may request an available export of your personal data or observations where the relevant functionality or applicable law provides that right. Any export may be limited to information that can lawfully and securely be provided without infringing the rights of others.

Deleting your FaunaMap account does not automatically cancel an Apple App Store or Google Play subscription. Cancel the subscription separately through the relevant platform before or after account deletion.

When an account is deleted, we will remove or anonymize associated personal data and User Content within a reasonable period, subject to the Privacy Policy, applicable law, legitimate retention obligations, and technical deletion periods.

Some information may remain temporarily in backups or be retained where necessary for legal compliance, fraud prevention, accounting, security, safeguarding, or dispute resolution. Public observations or scientific records that have already been anonymized, lawfully shared, published under an approved open-data license, or incorporated into third-party biodiversity datasets may remain available where permitted by law.

Comments, discussion threads, or collaborative records may be deleted, anonymized, or retained without identifying account information where necessary to preserve the integrity of another user's content and where permitted by law. Previously shared private messages may remain in a recipient's account where legally justified.

We may suspend or terminate access if you materially violate these Terms, misuse the service, endanger wildlife or users, repeatedly violate community rules, or if continued access would create a significant legal or security risk. Where reasonably possible, we will provide notice, reasons, and an opportunity to address or challenge the issue.

If a paid subscription is affected by account termination, any refund, continued access, or remaining contractual remedy will be determined in accordance with the reason for termination, the relevant app store arrangements, proportionality, and applicable consumer law. We will not retain fees in a manner prohibited by law.

25. Liability

We provide FaunaMap with reasonable care and skill. To the extent permitted by applicable law, we are not liable for losses resulting from:

• Inaccurate species identifications or user-submitted observations that we could not reasonably verify or prevent.
• Incomplete, delayed, or outdated map information.
• Decisions made by users while navigating, accessing land, or interacting with wildlife.
• Temporary interruptions caused by circumstances outside our reasonable control.
• Unauthorized actions of independent third parties that we could not reasonably prevent.
• Losses resulting from your misuse of the service or violation of these Terms.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law. In particular, nothing limits mandatory consumer rights or our liability for intentional misconduct, fraud, death or personal injury caused by negligence where applicable law prohibits such limitation, or other liability that cannot legally be excluded.

Where a limitation of liability is legally permitted, any limitation must be reasonable and proportionate in light of the circumstances, the contractual relationship, and the rights provided by applicable law.

26. Changes to these Terms

We may update these Terms to reflect changes in law, our services, technical requirements, business practices, safety needs, or platform rules. The current version will be published on our website or made available in the app.

For material changes affecting existing users or paid subscribers, we will provide reasonable advance notice where required by law. If a material change negatively affects your contractual rights, you may have the right to reject the change, cancel your subscription, obtain an available remedy, or stop using the affected service.

Changes will not retroactively alter rights or obligations that arose before the change took effect. If your express acceptance is legally required, the updated Terms will not apply without that acceptance. We may retain a record of the relevant version, language, acceptance timestamp, and account identifier for compliance and evidentiary purposes.

If these Terms are translated, we will identify the applicable language version presented to you. A language-selection clause does not deprive consumers of mandatory rights or the protection of information requirements applicable in their country.

27. Applicable law and consumer rights

These Terms are governed by the laws of the Netherlands, unless mandatory law in your country of residence provides otherwise. If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer laws that apply in the country where you live.

Nothing in these Terms prevents you from bringing a claim before a court that has jurisdiction under applicable law, including a court in your country of residence where you are legally entitled to do so. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

General contractual provisions

These Terms, the purchase conditions clearly presented for your subscription, and the community or nature guidelines expressly incorporated by reference form the agreement governing your use of FaunaMap. Our Privacy Policy separately describes personal-data processing and does not replace the rights and obligations imposed by applicable data-protection law.

If we do not immediately enforce a provision, this does not mean that we waive our right to enforce it later. A waiver applies only to the specific situation for which it was clearly granted.

You may not transfer your account, subscription agreement, or contractual rights to another person without our prior permission, except where applicable law or the relevant app store expressly permits the transfer. We may transfer our rights and obligations to a successor in connection with a merger, sale, reorganization, or transfer of the FaunaMap service, provided that the transfer does not reduce your mandatory rights and that any required information, objection rights, termination rights, or privacy safeguards are respected.

Provisions that by their nature should continue after termination remain applicable to the extent lawful, including provisions concerning accrued payment obligations, previously authorized content uses, intellectual-property protection, confidentiality of protected location information, complaints, liability, applicable law, and rights that arose before termination.

28. Additional terms for Apple App Store users

If you downloaded FaunaMap from the Apple App Store, the following additional provisions apply to the extent required by Apple's applicable terms:

1. These Terms are between you and FaunaMap, not Apple. FaunaMap, not Apple, is responsible for the app and its content except where applicable law or the transaction arrangement provides otherwise.
2. Your license to use the iOS app is a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the applicable Apple Media Services Terms and Conditions and any permitted family-sharing or volume-purchase arrangement.
3. Apple has no obligation to furnish maintenance or support services for FaunaMap.
4. If the app fails to conform to an applicable warranty, you may notify Apple. Where applicable, Apple may refund the purchase price paid for the app, and Apple will have no further warranty obligation to the maximum extent permitted by law.
5. FaunaMap, not Apple, is responsible for addressing claims relating to the app or your possession or use of it where required by law, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and consumer-protection, privacy, or similar claims.
6. If a third party claims that the iOS app or your permitted use infringes its intellectual-property rights, FaunaMap, not Apple, is responsible for the investigation, defense, settlement, and discharge of the claim to the extent required by Apple's terms and applicable law.
7. You represent that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country and that you are not listed on an applicable United States government list of prohibited or restricted parties, to the extent this representation is required by applicable law and Apple's terms.
8. You must comply with applicable third-party terms when using the app, including any relevant network, data-service, or mapping-provider terms.
9. Apple and its subsidiaries are third-party beneficiaries of these Apple-specific terms and may enforce them against you to the extent required by Apple's terms.
10. Questions, complaints, or claims concerning the app may be sent to Falco Solutions / FaunaMap at the business address and support email shown at the beginning and end of these Terms.

Nothing in this section limits mandatory consumer rights.

29. Contact, complaints, and legal notices

We will acknowledge or review complaints within a reasonable period appropriate to their urgency and applicable law. Reports involving immediate risks to children, serious threats, sensitive wildlife locations, or unlawful content may receive priority.

For purposes of applicable EU intermediary-service and platform rules, the email address above also serves as an electronic point of contact for users and competent authorities unless a separate contact point is clearly published. If you are a consumer, you may also have the right to contact a consumer protection authority, dispute-resolution body, data-protection authority, Digital Services Coordinator, or competent court in your country.

30. Model withdrawal notice

If applicable, you may use the following notice to withdraw from a qualifying subscription agreement. If your purchase confirmation identifies Apple, Google, or another party as the responsible seller or merchant, submit the request through that party's designated withdrawal or refund channel, or contact us for assistance.
